As we are a country who doesn’t follow uniform civil code, adoption being a civil matter falls under different personal laws of different religions. Due to the great efforts of Hindu liberals, in 1955 the parliament comes forward to make positive changes under Hindu personal law and subsequently in 1956 after great protest also passed hind adoption and maintenance act 1956. Which includes Buddhists, Jains, and Sikhs under the ambient of word Hindu? And since then they can adopt the child according to this law.
But unfortunately other religions like Muslims ,Christians, parasites didn’t accepted the same changes in their personal laws at all and since then they can’t adopt a child legally , if any citizen of these religion wanted the guardianship of a child then they need to follow guardians and wards act 1890 which has lot of flaws.
And
this is the reason till 2014 not a single adoption took place by anyone except
Hindus. Because they don’t have any legal authority to adopt a child.
But in 2014 when Delhi high court pronounced a judgment regarding other
religions also in some circumstances they can also adopt.
